1. Introduction

We will need you to update us with your latest personal data from time to time. We will treat your personal data with confidentiality of the highest standard. The purposes of collection of your personal data will be stated in this privacy policy, and whenever necessary, the relevant parts, sections, and/or pages of the Website. The Company is committed to ensuring that all personal data are being collected, retained, processed, and handled in accordance with the security measures and principles as prescribed by the local laws, along with its regulations and standards, where your personal data is being processed.

2.2. You have the right to request access to and correct your personal data, and if you have any inquiries or complaints in respect of your personal data you may contact us directly via the modes as provided under Clause 12 below.

Your personal data when collected, may be shared with our authorised subsidiaries or affiliated companies, and further processed by us or our authorised subsidiaries or affiliated companies solely for the purposes of its collection. We will at all times respect your statutory rights to privacy save where consent has been granted for use or sharing for other purposes.

2.4. The Company will keep your personal data private and confidential, and ensure that its policies and practices in relation to the collection, use, retention, transfer, processing, and access of your personal data comply with the latest laws where your personal data is being processed in.

3. Information Collection Notice

3.1. The Company will collect or receive personal data about you from time to time. Such data includes but is not limited to your personal data given to us in the course of your normal commercial dealings with us.

3.2. "Personal data" that may be collected by us shall include the following:

(a) your personal identification information (such as name, occupation, address, contact details, identification or passport number, date of birth, email address, telephone number, your age etc.); or

(b) relevant sensitive data which may be advised from time to time.

3.3. When you interact with us via the Website or our mobile application or platform, we may collect information about your location and mobile device. You may decline to share your location via mobile device with us by disabling your location services on your mobile device at any time.

4. Use of Information Collected

4.1. Your personal data collected by us may be used for the following purposes:

(a) Processing applications/enrolments, identity verification, and student affairs;

(b) Carrying out the maintenance of your membership as a member of the Company;

(c) Establishing/determining membership benefits for Company's members;

(d) Promotional notifications and other services;

(e) Updates on course plans, systems, and product information;

(f) Internal research and analysis, including the development of course-related needs, services, and product information or gifts by the Company;

(g) Ensuring the daily operation of services, systems, and products;

(h) Conducting customer satisfaction surveys and statistical study;

(i) Market promotion of the latest news;

(j) Notifying you of joint promotions or charity events with charitable organizations or non-profit organizations;

(k) Verifying membership for redeeming offers;

(l) For service fee payments;

(m) For optimised provision of our products and services to you; and

(n) Any other purposes related to the above.

4.2. Notwithstanding Clause 4.1 above, you acknowledge that the personal data provided may further be used and retained by the Company for the following purposes:

(a) Whenever required by law;

(b) With your consent to the Company; or

(c) Pursuant to any specific order by a competent court.

5. Verification of Personal Data

5.1. Prior to using our products and systems, we will request you to provide us with your personal data and submit the related documents for verification purposes.

5.2. By using our products and systems, you agree and confirm that the personal data provided are true to reflect your identity, and the documents submitted are authentic and details therein are accurate. In no event shall you use another person's information or an alter ego to pass it off as your own.

5.3. If you fail to submit the original identity card or relevant supporting documents, or if we discover that you have provided inaccurate information or attempting to pass off another person's information or an alter ego as your own, we reserve the right to immediately deny you access to our services, systems, and/or products.

5.4. You may be required to provide us with your identifiable personal information from time to time, including but not limited to your name, gender, age, identity document number, date of birth, telephone number, fax number, address, email address, education level, occupation, interests, and preferences. If you choose not to provide such information, we reserve the right to immediately deny you further access to our services, systems, or products as your refusal may hinder our ability to offer and/or provide you the best and appropriate services.

5.5. In the course of fulfilling our responsibilities, we may, to the extent permitted by law, match, compare, convert, or exchange any personal data provided by you or subsequently obtained with data held by government agencies, other regulatory bodies, stock exchanges, companies, organizations, or individuals in Malaysia and overseas for the purpose of data verification.

6. Data Retention

6.1. The headquarter of the Company is in Hong Kong. However, we may transfer and store your personal data on our servers located overseas. Such transfers are required for us to fulfil our obligations towards you and/or our obligations with the relevant third parties.

6.2. The Company has the right to retain your personal data for the purpose of your engagement with us, and we shall keep your personal data no longer than necessary for the fulfilment of that purpose. Nonetheless, if you inform us of your temporary cessation of using our products and/or systems only temporarily, you agree and consent to allowing us to retain your personal data for up to three (3) year(s) for processing, should you resume using our product and/or systems within that period.

6.3. We will take all reasonable steps to ensure that your personal data is destroyed or permanently deleted if it is no longer required for the purpose for which it was to be processed.

6.4. We will secure your personal data in the following manners:

(a) Register those who have access to your personal data;

(b) Maintain a proper record of persons accessing to your personal data;

(c) Control and limit access to your personal data only on a need-to basis;

(d) Maintain a proper record of any transfer of your personal data;

(e) Ensuring all staff, employees, contractors, agents, directors, and other third parties having access to your personal data be subjected to the similar or equal confidentiality standard of this Privacy Policy;

(f) Ensuring all our staff and employees are aware of their responsibilities to protect your personal data;

(g) Ensuring no person using removable device or cloud computing service to transfer or store your personal data in other places without written consent from the Company;

(h) Performing data protection impact assessments (DPIAs) from time to time to evaluate and mitigate risks of data breach; and

(i) Appointment of a Data Protection Officer (if applicable).

7. Access to Personal Information

7.1. Subject to the local laws where your personal data is being processed, you will be given access to your personal data collected and retained by us.

7.2. You may contact us via email or messaging to request access to your personal data. The relevant contact details are provided under Clause 12 below.

7.3. Please note that we may refuse to comply with your access request, if:-

(a) You fail to supply us with such information as you may reasonably required in order to satisfy us as to your identity;

(b) You fail to supply us with such information as may be reasonably required to locate your personal data to which the data access request relates;

(c) The burden or expense of providing access is disproportionate to the risks to your privacy in relation to the personal data vis- -vis the case in question;

(d) We cannot comply with your request without disclosing personal data relating to another individual who can be identified from that information, unless otherwise consented by the other individual or it is reasonable in all the circumstances to comply with your request without the other individual's consent;

(e) Providing access would constitute a violation of an order of a competent court;

(f) Providing access would disclose confidential commercial information; or

(g) Such access to personal data will infringe other relevant laws.

7.4. The following is applicable to personal data processed in Malaysia only:

(a) According to Section 30(2) of the Personal Data Protection Act 2010, we may charge you a reasonable fee for accessing the data. However, if you are genuinely accessing the personal data for the purpose of making reasonable corrections, the Company may consider waiving such fees.

(b) The Company will process your request in accordance with Sections 30 and 31 of the Personal Data Protection Act 2010. If the company is unable to complete the access process within 21 days, you will receive a reasoned written notification, along with the expected timeline of no more than 14 days for the completion of the access process.

8. Correction of Personal Data

8.1. You may contact us via email or messaging us to request the correction of your personal data and provide the accurate information for correction where your personal data is inaccurate, incomplete, misleading or not up to date.

8.2. You must ensure that the submitted data is accurate and correct. Otherwise, the Company may charge you a reasonable fee for accessing the data for further changes. If the Company's staff is not satisfied that the personal data to which a data correction request relates is inaccurate, incomplete, misleading or not up-to-date, the Company reserves the right to refuse processing the application.

8.3. The following is applicable to personal data processed in Malaysia only:

(a) If the data is relevant and accurate to correct the inaccurate, incomplete, misleading or not up-to-date data, the Company will correct your personal data within 21 days from the date of receiving your request, as stipulated in Section 35(1) of the Personal Data Protection Act 2010.

(b) Similarly, if the company is unable to complete the correction process within the said 21 days, you will receive a reasoned written notification, along with the expected timeline of no more than 14 days for the completion of the correction process.

9. Security

9.1. The personal data provided by you to us will be securely stored within the Company's website system and your personal data can only be accessed by our authorized personnel.

9.2. The website system will encrypt and securely store the data in real-time, and only authorized and trained employees will be granted access to such information. The Company will keep all relevant personal data confidential and store them on the Company's computer servers.

9.3. The Company will ensure that its employees observe the data protection principles and comply with all practices relating to personal data and security. To prevent data theft and unauthorized access, the computer servers will also regularly perform data backups and system updates.

10. Consent for Collection, Use, and Disclosure of Personal Data

10.1. We will obtain your consent to collect, use, transfer, and process your personal data at the time of collection, unless legally exempted under certain circumstances.

10.2. Whenever required by law, we will adopt an 'opt-in' policy to obtain your express written consent when collecting your personal data, and you may be asked to click next, to sign a form or tick a box etc., to signify your consent.

10.3. Notwithstanding the above, in using the Website, you consent to the collection and use of your personal data by us in the ways and purposes stipulated herein unless and until you expressly notify us otherwise.

10.4. You may submit a request to withdraw your consent at any time by emailing or messaging us. Relevant contact details are provided in Clause 12 below.

10.5. By providing us with any third party's personal data, you represent and warrant that the third-party individual has been informed of and consented to the terms of this Privacy Policy and Personal Data Protection Statement.

11. Minors (Under Age of Majority)

We cannot determine the ages of visitors to our Website. If you are a parent or guardian of someone under the legal age of majority in the territory where you reside, who has provided us with their personal data without your knowledge and consent, you may request that we remove such information by contacting us. Relevant contact details are provided in Clause 12 below.
